These Terms and Conditions ("Terms") govern your access to and use of GrihSwami — operated by UPYOGI MEDIA AND ADVERTISEMENT (OPC) PRIVATE LIMITED. Please read them carefully before creating an account or using any feature of the Platform.

1. Acceptance of Terms

1.1 Agreement

By accessing or using Grihswami (the "Platform") — including our website at grihswami.com and our mobile application — you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree, you must not use the Platform.

1.2 Eligibility

You must be at least 18 years of age and legally capable of entering into contracts under the Indian Contract Act, 1872 to use the Platform. By using Grihswami, you represent that you meet these requirements.

1.3 Changes to Terms

We reserve the right to update these Terms at any time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes constitutes your acceptance of the new Terms.

2. Platform Description

2.1 Nature of Service

Grihswami is an online real estate marketplace that connects property buyers, renters, sellers, and agents. We provide tools to browse, list, and inquire about residential and commercial properties across India.

2.2 No Real Estate Agency

Grihswami is a technology platform and is not a real estate agent, broker, or licenced property dealer. We do not participate in property transactions and are not a party to any agreement between buyers and sellers.

2.3 Information Only

Content on the Platform — including listing details, price trends, locality data, and blog articles — is for informational purposes only and does not constitute legal, financial, or investment advice.

3. User Accounts

3.1 Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3.2 Account Types

We offer three account roles: User (default), Seller/Agent, and Admin. Agents must complete KYC verification and receive admin approval before accessing agent-specific features such as commission escrow.

3.3 Account Security

You agree to notify us immediately at support@grihswami.com if you suspect any unauthorised access to your account. We are not liable for losses resulting from unauthorised use of your account.

3.4 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period, with or without prior notice.

4. Listings & Content

4.1 Seller Responsibility

Users who post property listings ("Sellers") are solely responsible for the accuracy, legality, and completeness of listing content, including property details, photos, price, RERA registration status, and documents.

4.2 Prohibited Listings

You may not post listings that are fraudulent, misleading, or non-existent; that violate applicable laws or regulations; that infringe third-party intellectual property rights; or that involve properties subject to legal disputes without disclosure.

4.3 RERA Compliance

Properties required to be registered under the Real Estate (Regulation and Development) Act, 2016 must display a valid RERA registration number. Grihswami may remove listings found to be non-compliant.

4.4 Content Removal

We reserve the right to remove any listing or content that violates these Terms, applicable law, or our community standards, at our sole discretion and without prior notice.

4.5 Listing Limits

The number of active listings per account is governed by your subscription plan. BASIC_FREE accounts may post up to 5 active listings; higher-tier plans allow more.

5. Inquiries & Transactions

5.1 No Transaction Guarantee

Grihswami facilitates communication between buyers and sellers but does not guarantee that any inquiry will result in a completed transaction. All negotiations and agreements are between the parties involved.

5.2 Due Diligence

Buyers are strongly advised to independently verify property ownership, encumbrances, RERA status, and all documents before entering into any agreement. Grihswami is not liable for losses arising from failure to conduct due diligence.

5.3 Visit Scheduling

Property visit scheduling via the Platform is a convenience feature. Grihswami does not guarantee that visits will be confirmed, and is not responsible for any loss or inconvenience arising from cancelled or rescheduled visits.

6. Subscriptions & Payments

6.1 Subscription Plans

Premium subscription plans (Silver, Gold, Platinum) are billed monthly, quarterly, or yearly. Prices are listed on the Premium page and are subject to change with 30 days' notice. All prices are inclusive of 18% GST.

6.2 Payment Processing

Payments are processed by Razorpay, a third-party payment gateway. By completing a payment, you also agree to Razorpay's terms of service. Grihswami does not store your card or bank details.

6.3 Refund Policy

Subscription fees are non-refundable except as required by applicable law. One-time service fees (Featured Boost, Photography, etc.) may be refunded within 24 hours of purchase if the service has not been initiated.

6.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You can cancel your subscription from the Premium section of your account.

6.5 Coupons & Referrals

Discount coupons and referral credits may be applied to eligible subscription purchases. They are non-transferable, cannot be exchanged for cash, and are subject to expiry and usage limits specified at the time of issue.

7. Agent & Escrow Services

7.1 Agent Verification

To access agent-specific features, you must complete KYC verification and receive admin approval. Providing false KYC information is a material breach of these Terms and may result in immediate account suspension and legal action.

7.2 Commission Escrow

The escrow service holds commission payments on behalf of agents until transaction milestones are met. Grihswami charges a 1.5% platform fee on escrow transactions. Escrow funds are held in trust and not commingled with operating funds.

7.3 Disputes

Escrow disputes must be raised through the Platform within 7 days of a payment milestone. Admin decisions on disputes are final within the Platform. Parties retain the right to pursue external legal remedies.

8. Intellectual Property

8.1 Our IP

All intellectual property on the Platform — including software, design, logos, brand name ("Grihswami"), text, and graphics — is owned by or licenced to UPYOGI MEDIA AND ADVERTISEMENT (OPC) PRIVATE LIMITED. You may not reproduce, distribute, or create derivative works without our express written consent.

8.2 Your Content

By posting content on the Platform (listing photos, descriptions, reviews), you grant Grihswami a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content in connection with operating the Platform.

8.3 Copyright Complaints

If you believe content on the Platform infringes your copyright, please contact support@grihswami.com with details of the infringing content and proof of your ownership.

9. Prohibited Conduct

9.1 You must not:

Post false, misleading, or fraudulent listings or reviews; harass, threaten, or abuse other users; attempt to reverse-engineer, scrape, or copy the Platform; use automated bots to submit inquiries or create accounts; circumvent security measures or access controls; use the Platform for any unlawful purpose; impersonate another person or entity.

10. Disclaimers & Limitation of Liability

10.1 As-Is Service

The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

10.2 No Liability for Transactions

Grihswami is not liable for any loss, damage, or harm arising from transactions between users facilitated through the Platform, including property disputes, payment disputes, or failure to complete a transaction.

10.3 Limitation

To the maximum extent permitted by law, our total liability to you for any claim arising from use of the Platform shall not exceed the amount paid by you to Grihswami in the 3 months preceding the claim.

11. Governing Law & Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Real Estate (Regulation and Development) Act, 2016.

11.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hyderabad, India.

11.3 Informal Resolution

Before initiating legal proceedings, we encourage you to contact us at support@grihswami.com so we can attempt to resolve the issue informally within 30 days.
